Terms and conditions

(M3 Healthcare B.V. trading as Kaakchirurgie Zuidas)

Article 1 – Definitions
In these general terms and conditions, the following terms are defined as:

  1. Clinic: M3 Healthcare B.V. trading as Kaakchirurgie Zuidas, located in Amsterdam.

  2. Patient: the natural person who enters into a treatment agreement with the Clinic.

  3. Treatment Agreement: the agreement as referred to in Article 7:446 of the Dutch Civil Code (Medical Treatment Agreement Act – WGBO).

  4. Treatment: all medical and oral surgery care provided by or on behalf of the Clinic to the Patient.


Article 2 – Applicability

  1. These general terms and conditions apply to all treatment agreements and other legal relationships between the Clinic and the Patient.

  2. Deviations from these conditions are only valid if explicitly agreed upon in writing by the Clinic.


Article 3 – Formation of the treatment agreement

  1. The agreement between the Clinic and the Patient is concluded once the appointment for a treatment has been confirmed.

  2. The Clinic may refuse treatment if there are legitimate reasons, for example if the required medical information is lacking or in case of outstanding debts.


Article 4 – Appointments, cancellation and non-attendance

  1. An appointment may be rescheduled or cancelled free of charge up to 24 hours in advance.

  2. In case of non-attendance or cancellation within 24 hours, the Clinic reserves the right to charge for the planned treatment or consultation time.

  3. The Patient is expected to arrive on time for the appointment.


Article 5 – Payment and invoicing

  1. Payments are processed via Infomedics.

  2. The Patient receives an invoice from Infomedics which can be submitted to the health insurance provider.

  3. Oral and maxillofacial surgery is covered under the Dutch basic health insurance; however, the Patient remains responsible for any deductible (“eigen risico”) or costs not reimbursed by the insurer.

  4. If an invoice is not paid (on time), the Patient is in default and collection costs may be charged.


Article 6 – Obligations of the patient

  1. The Patient is obliged to provide complete and accurate (medical) information relevant to the treatment.

  2. The Patient must follow the instructions and advice of the treating specialist.

  3. The Patient must behave respectfully towards staff members of the Clinic and other persons present.


Article 7 – Liability

  1. The Clinic is only liable for damage that is the direct result of an attributable shortcoming in the execution of the treatment, insofar as the Clinic is insured for such damage or should reasonably have been insured.

  2. Any liability of the Clinic is limited to the amount paid out in the relevant case under the professional liability insurance.

  3. The Clinic is not liable for damage resulting from incorrect or incomplete information provided by the Patient.


Article 8 – Intellectual property

  1. All information, brochures, advice and other material provided by the Clinic are intended solely for the Patient’s personal use and may not be copied or made public without prior written consent of the Clinic.


Article 9 – Complaints procedure

  1. Complaints about treatment or services must be submitted to the Clinic as soon as possible, but no later than two months after discovery.

  2. The Clinic has a complaints procedure in accordance with the Dutch Healthcare Quality, Complaints and Disputes Act (Wkkgz).

  3. If a complaint cannot be resolved by mutual agreement, the Patient may submit the complaint to an independent dispute resolution body or the competent court.


Article 10 – Governing law and jurisdiction

  1. The legal relationship between the Clinic and the Patient is governed exclusively by Dutch law.

  2. Disputes will be submitted in the first instance to the competent court in Amsterdam.


Article 11 – Amendments

  1. The Clinic is entitled to amend these general terms and conditions.

  2. Amended terms will apply from the date of publication on the Clinic’s website, unless otherwise indicated.
